Workshop Terms And Conditions
The following terms and conditions apply to all companies and or persons or other entities (“you”) that are attending any Training (“Training” or “Course”) organized by Rossiter System LLC (“we” or “us”). Please ensure you have read and understand the following:
Acceptance of terms and conditions
By completing the registration form for a particular training, you are agreeing to the terms and conditions set out below (“Terms”) and they will be incorporated into the contract between us (“Contract”). You will ensure that your employees, partners, agents, contractors, subcontractors and any other person attending the Training on your behalf shall comply with these Terms. The Contract is formed when we send you a booking confirmation
Registration and Payment
The fee for attending the Training (“Course Fee”) must be paid in full at the time of booking your training. An order confirmation will be automatically sent out which will confirm your booking.
All payments for the Course Fee must be made thru Rossiter System LLC whether paid online or by check sent to Rossiter System LLC, and in full at the time of completing the registration form and in any event, prior to the date of the Training. If payment is not received within 7 days of your registration, your registration will be cancelled and the payment of any refund will be at our complete discretion. Payment will be made via our merchant account provider (and you consent to us passing your necessary details to the merchant account provider and to them processing necessary information about you) or directly to our bank account, as notified to you. We reserve the right to run price promotions as we deem appropriate.
Cancellation and Refund Policy
There may be circumstances in which we need to cancel or re-schedule the Training and you are unable to attend the new date. In such circumstances, we will provide you with a full refund of the amount of the course fee that you have paid to us and we will make every effort to provide you with such refund within 30 days of the date of cancellation.
Cancellation by participants must be made in writing. Cancellation up to 60 days before start 10% of the full course fee. Cancellation until three weeks before start: 50 % of the course fee. Cancellation less than three weeks before start and no-shows: 100 % of the course fee. There are also deposits that are due at the start of each Course.
In some cases, instead of cancellation, you might also have an opportunity to transfer the funds to a future training with same or different Instructor. You can request the Instructor or write to firstname.lastname@example.org for clarifications.
We are not responsible for any other costs which training participants may have incurred including but not limited to travel, hotel, car rental, insurance, other misc. purchases and/or rentals.
Postponement or Change to Venue
If you have booked and paid for a training and are unable to attend on the training date, and if another similar training is offered, you can choose to transfer your booking to the next training. An administration fee of $25 per booking will be incurred, payable at time of your request to transfer your booking. If the subsequent training is cancelled by us, you will receive a full refund.
There may be circumstances in which we need to postpone the Training or change the venue at which Training is to be held and if we do, we shall advise you of this as soon as we possibly can. If the postponement is for more than 6 months after the publicized date of the Training or the replacement venue is more than 50 miles away from the publicized venue, you may cancel by emailing us at email@example.com and we shall provide you with a full refund.
At any time, your training maybe moved into the virtual class room. An email will be sent out explaining the process and requirements. These virtual classroom trainings will have the same curriculum and will be run around the same date as the originally scheduled training. You will also have the chance to schedule some one on one time for an additional fee, to go through ROSSITER SYSTEM TECHNIQUES and ask any questions you might have.
Please note that bookings cannot be transferred within two weeks of the training date.
Training Schedule and Agenda
All training schedules and plans are subject to change at our discretion depending upon weather, health and safety considerations, or any other factor related or unrelated to photographic opportunities as we deem appropriate.
Limitations of Liability
Whilst every reasonable precaution is taken by us to ensure security and safety at the training, we shall not in any way be liable for any loss or damage suffered by you or your personal belongings whatsoever in relation to the Training, save that nothing in these Terms shall be deemed to limit the liability of any person for death or personal injury caused by negligence.
We can accept no responsibility for losses or additional expenses due to delay or changes in the services to be provided. We reserve the right to change our arrangements should conditions necessitate, or to cancel any aspect of the training due to exceptional circumstances. In the event that we deem it necessary to cancel the training we will provide a full refund, which the participants acknowledge as full and final settlement. In the event of a training cancellation by us, our total liability for any matter arising out of the Contract shall in all circumstances be limited to the price paid by you for the Training and we shall not in any circumstances be liable to you for any consequential loss whatsoever.
By joining any trainings offered by us, you acknowledge that you are aware of risks and are physically capable of safely taking part in the training. Further, you release ROSSITER SYSTEM LLC, Rossiter.com, therossitersystem.com, guest presenters, training instructors and models from any liability. ROSSITER SYSTEM LLC, Rossiter.com, therossitersystem.com, guest presenters, Rossiter System training instructors and models will assume no liability for injury, illness or loss of personal property or expenses associated with participation in a training.
If you act in any way which in our opinion is likely to cause any harm or nuisance to any person at the Training, you will be required to leave the Training and we shall not be liable to refund your Course Fee or any other payment.
You must comply at all times with the health and safety policy of the venue. You must comply with all requests from us or the venue with regard to health and safety and failure to do so will result in you being asked to leave the training (in which case no refund will be provided). You may not bring any equipment or items of a hazardous or dangerous nature to the Training.
You shall not cause any damage to any part of the venue (including outside areas, and all inside walls, flooring, fixtures and fittings). You are solely liable for any damage caused by you, your employees, contractors, sub-contractors and agents to any such area of the venue and shall fully reimburse us in relation to any damage so caused.
You must keep your personal belongings with you at all times and we accept no liability for any damage to, loss of or theft of any of your belongings or other items brought to the Training by you.
Promotional materials and materials at the Training
You agree that we may include your details or pictures in any promotional materials relating to the Training and/or any materials used at the Training. We are not liable for errors or omissions contained in such information.
Unless otherwise stated, the copyright for any such promotional materials and any materials used at the Training (including course notes, slides, brochures, articles and case studies) belongs to us and may not be reproduced in any medium without our prior written consent.
You may use such materials for your own business purposes only and may not reproduce, publish or deal with such materials in any way for any commercial use.
We reserve the right to change the published program (including the publicized speakers) or materials as we deem appropriate.
Photography and filming
You may not photograph or video the Training without our prior consent. Any approved filming or photography is the property of Rossiter System LLC.
We will communicate with you using the contact details provided on the Registration Form for the purposes of the Training. We shall be entitled to pass on all of your contact details to the training instructors.
Travel, accommodation and refreshments
You shall be responsible for making and paying for your own travel, accommodation and refreshment arrangements. If you are late at the training or prevented from attending the Training due to travel delays or any other circumstances, we shall not be obliged to provide you with a refund or to wait to start the Training until you arrive.
Disability, medical conditions and dietary requirements
If you have any disability or medical condition that requires us to make special arrangements for you or any special dietary requirements, please email us at firstname.lastname@example.org as soon as possible and in any training at least 2 weeks prior to the date of the Training.
Your Agreement to this Contract
In reserving a place on the training by paying the training fee, you are agreeing to accept all the above conditions. The person who makes the booking does so on behalf of all the individuals included, and all are bound by the booking conditions.
